News / Congestion and delays at port of Felixstowe expected to continue

The UK’s major container gateway of Felixstowe is expected to continue experiencing severe congestion after the troubled implementation of a new IT system. An advisory issued by MSC said all carriers calling at the port were still experiencing “significant delays”.“MSC expects these delays to continue, which will affect vessel arrival times and collection and delivery slots.“We continue to work very closely with the port of Felixstowe to mitigate this situation and we are working hard to minimise the impact on our customers.” Its 2M partner, Maersk, also advised customers it was working with the port to resolve the issues, and Cosco issued a notification citing “severe delays”, which it said were leading to “serious service failures”.One source told The Loadstar the delays had resulted in the port suspending rail import services, although a spokesperson for the port denied this. The spokesperson said: “One train was cancelled last night and another today, though we understand that was due to issues with the locomotive.”Two vessels – Evergreen’s Thalassa Elpida and the MSC Cordoba – remain at anchor off the coast waiting to call at the port, as is the OOCL Japan, according to marinetraffic.com.The source said that some carriers were bypassing Felixstowe for alternative ports, including London Gateway.A spokesperson for port operator DP World told The Loadstar it was aware of the problems. “DP World London Gateway and DP World Southampton are in regular discussion with all of our customers,” said the spokesperson. “And we are providing assistance where we can to ensure UK trade can continue to flow.”Felixstowe installed the nGen terminal system on Sunday, but despite claiming a “successful migration”, reports of severe delays and cancellations began circulating the following day.In a statement issued to customers on Tuesday, seen by The Loadstar, the port described the implementation of any major operating system as a “complex process”.“We are currently experiencing system communication inconsistencies within the container yard which are having a knock-on effect on yard performance,” it added.“All our container yards remain open, processing over 3,800 trucks yesterday, and the team is working to resolve the issues with normal operations expected to resume in 24-36 hours.” By Alexander Whiteman 15/06/2018 read more

CPS to recruit new lawyers to improve ‘poor’ performance

first_imgThe new head of London’s Crown Prosecution Service has announced it will recruit 42 new lawyers in a bid to improve service following a review that found performance in over a third of the capital’s boroughs was ‘poor’. The report of Her Majesty’s CPS Inspectorate on the performance of 20 of the 32 London boroughs assessed the performance of 12 as ‘poor’, seven as ‘fair’ and one as ‘good’. Overall, the review found the main failings were in Crown court casework, disclosure, magistrates’ court casework, service to victims and witnesses, and the handling of serious violent and sexual offences, which were all rated as ‘poor’ across the boroughs. However, the inspectors said the Complex Casework Unit, which handles murders and other serious and sensitive cases, performs well, and the management of custody time limits across the boroughs has improved. London chief Crown prosecutor Alison Saunders said the service is recruiting 42 more lawyers and increasing the number of paralegal assistants in Crown courts.last_img read more

PI solicitor helped client who wanted to hide damages from husband

first_imgAn experienced personal injury lawyer has agreed to be struck off after drafting a letter to help a client conceal from her husband the extent of a damages settlement. Geoffrey Hart, a former director with Midlands firm Ward & Rider, had secured damages of £48,000 after costs for his client in 2017. But, during a telephone discussion, the client advised Hart she would be telling her husband the claim settled for £30,000 and asked him to prepare a letter confirming the lower amount.Hart then wrote to state damages were £30,000 and broke down the elements of the claim. He wrote a further letter two weeks later referring to the £30,000 figure. The Solicitors Disciplinary Tribunal heard that the client, who was a family friend of Hart’s wife, had told him she wanted to keep some of her own damages because her husband was controlling and would decide how the money was spent.Hart submitted that he became ‘very emotional’ after learning the client had gone through tragic events in her personal life similar to those he was experiencing at the time, and he acted out of character in drafting the false letter.A clinical psychologist report confirmed that Hart made a mistake while experiencing psychological difficulties and some associated impairment in cognitive processing – namely judgement and reasoning.Hart, a solicitor for 21 years, made no attempt to conceal the relevant letters and upon realising the seriousness of the matter he pressed his employer to recall the letter. He was reported to the SRA by his firm and resigned shortly after. The false letter was not shown to the client’s husband or anyone else. The tribunal heard that Hart also admitted sending an email to his wife, a solicitor, which included personal information about another client who had suffered a personal injury. The email was to provide his wife with a precedent document for her own legal practice.Hart and the SRA agreed on a joint outcome that he be struck off and pay £9,000 costs.last_img read more
